ONE YEAR AGO: Brent Corrigan testifies in the Bryan Kocis Murder Trial (pics & videos):

Bryan Kocis, owner of Cobra Video for whom Brent Corrigan worked while underage, was found dead at his home Jan. 24, 2007. His throat had been slashed and he had been stabbed 28 times. The killers set his home on fire to hide the murder.Corrigan was one of several people to be questioned. His attorney, John Yates, said that Corrigan was part of the investigation and "fully" cooperating with authorities. Yates later said Corrigan had information about a man who met with Kocis that day, but they are looking for the services of a criminal lawyer before talking to police.Police then searched for a "person of interest" named in the investigation.On May 15, 2007; two Virginia Beach escorts and rival producers of gay pornography, Harlow Cuadra and Joseph Kerekes, were charged with Kocis' murder.The theory by investigators was that the two men murdered Kocis because they wanted to get Corrigan to work for them at their porn film company. However, police investigating the murder believe Corrigan didn't know these two men would actually go and kill Kocis to get him to work for their company. On Dec. 8, 2008, Kerekes pleaded guilty to the murder of Bryan Kocis and was subsequently sentenced to life in prison without parole, avoiding a potential death sentence. Jury selection for Cuadra's trial began Feb. 17, 2009, and the trial began Feb. 24. On Feb. 27, 2009 Brent Corrigan testified for the prosecution. On March 12, 2009, Harlow Cuadra was found guilty and convicted of first degree murder in Kocis' death. On March 16, 2009, Cuadra was sentenced to life in prison without the possibility of parole. chinOne of my favorite bloggers, Jim made his last post today ending a 2 year and 198 post run on the 2nd anniversary of the arrest of Harlow and Joe, the two convicted murderers who now sit in prison for the murder of Bryan Kocis (Cobra Video Owner). Jim's post will be missed and we want to thank Jim for adding us to his blog roll sometime back just as the murder trial started to heat up. I've gained considerable knowledge from reading Jim's blog over the past year. Take care Jim and hope we see you around cyberspace again soon! Harlow's Appeal Takes Turn

harlowmainAttorneys for Harlow Cuadra have asked a judge to remove them from Cuadra’s appeal of life without parole for the killing of Cobra video owner Bryan Kocis. Lawyers Paul Walker and Joseph D’Andrea said in a court filing that they do not believe Cuadra has the money to pay them and asked the court to appoint new attorneys to handle the appeal. Judge Peter Paul Olszewski, Jr. will hold a hearing on May 22 for Walker and D’Andrea to argue why they should be withdrawn from the case. Last month, the two filed an appeal of the conviction and sentence. The Superior Court of Pennsylvania has not indicated when the appeal might be heard. Cuadra was convicted on March 16 of killing Kocis. Cuadra’s former lover and business partner, 35-year-old Joseph Kerekes, already is serving life after pleading guilty last December to second degree murder after making a deal with prosecutors. Harlow Cuadra Appeals

001Harlow Cuadra is appealing his conviction of life without parole for the killing of Cobra video owner Bryan Kocis. In a court filing, lawyers for Cuadra stated that Cuadra “hereby appeals to the Superior Court of Pennsylvania from the conviction and sentence on March 16, 2009.” Cuadra’s former lover and business partner, 35-year-old Joseph Kerekes, already is serving life after pleading guilty last December to second degree murder after making a deal with prosecutors. Kocis’ body was discovered in his home in 2006 by firefighters responding to a blaze in the rural home. More than 80 percent of the body was covered by third-degree burns and police said the fire had been set deliberately to destroy evidence. Forensics experts were able to resurrect the hard drive of a computer found at the scene. The contents led investigators to Cuadra and Kerekes. Cuadra and Kerekes saw Kocis as a competitor. The 27-year-old Cuadra had faced a death sentence, but the jury of eight men and four women could not reach a unanimous decision on whether the prosecution had met the burden of proof that the death penalty was appropriate. harlowDuring his trial, Cuadra took the stand in his own defense and testified that Kerekes was a controller.  He said that Kerekes managed his e-mail accounts and held Cuadra’s credit and identification cards at all times, even when they went out. Cuadra, crying openly, told the jury that as a child he had been sexually abused by his stepfather and hid his homosexuality until he left the Navy. But two police officers who arrested the pair offered conflicting testimony. Luzerne County Detective Daniel Yersha told the court that after Cuadra listened to the charges he told investigators that Kerekes was not involved. “He said, ‘Joe didn’t do it,’” Yersha testified. A second detective involved in the arrest, Dallas Township police Sgt. Doug Higgins, corroborated Yersha’s testimony. Higgins said that after the charges were read, something that took 75 minutes, he asked Cuadra if he were hungry. “He blurted out, Joe didn’t do it,” Higgins testified. A forensics investigator testified that a laptop computer seized from Cuadra’s home had several pictures of Kocis saved to it, as well as nude photos of Cuadra that were sent to Kocis just days before the killing. The prosecution argued that the photos of Kocis were to help Cuadra identify him, and that the nude shots of Cuadra were meant as a lure to get into Kocis’ home.

What About The Appeal Process ?

By Matthew Conaster: The Notice of Appeal is required to be filed within the time allowed by statue (usually 10-30 days following final judgment). Its a simple form and doesn’t set forth the grounds or argument of why he is appealing. Following this filing of the Notice of Appeal the higher court’s clerk will docket the appeal and a time schedule is set by the Appellant Court as to when the briefs are to be filed. Typically the court will order the verbatim transcripts to be prepared by the court’s reporter and address and rule on any matters concerning the defendant’s petition if any to proceed In Forma Pauperis (latin for ‘broke as fuck’) before the appeals process truly begins. I would suspect Harlow has no funds to retain counsel for his direct appeal. Since a direct appeal is a constitutional right afforded to any criminal defendant the court will be required to appoint counsel to represent Harlow on appeal if they find Harlow has no means to employ counsel. His trial attorneys (who were retained during trial) may end up most likely not representing Harlow on appeal and the court will appoint counsel from a pool of attorneys usually more experienced with appeals. Once the initial brief is filed the Commonwealth Attorney General’s office will answer the brief in writing. This process will take many months to complete before the Appeals Court will consider and rule on the appeal. If the Commonwealth Appeals Court Affirms Harlow’s verdict and sentence then Harlow may petition the US Supreme Court for a Writ of Certiorari to hear the appeal court’s decision. If that fails Harlow will then have no other course to fight his case short of another action known as Writ of Habeas Corpus which is basically a post conviction petition that usually shows things like new evidence coming forth or some other matter not then known to everyone during the course of the initial trial. All of these appeal hearings will be mostly done on paper with no appearance in court by Harlow himself. The appeals court may grant a few minutes to Harlow’s attorney for an oral argument before the panel of appeal judges - but short of that this will all be done on paper. Meanwhile Harlow will learn about all of this via US Mail. In fact more people will know about what’s going on before Harlow himself knows. Bottom-line as I see it, Harlow’s trial was more than fair and short of some new evidence that would appear to show him innocent of the crime he doesn’t stand a snowball’s chance in hell. His best bet will be to become a model inmate and hope somewhere in the future the laws may change and afford him a chance at parole or a reduction in his sentence for being a good boy. This is a very likely event that may come to pass as prisons become more crowded and politics shift away from anti-crime legislature. The late 1960s were the last era of this type of current change. According to the investigating coroner, Kocis was stabbed 28 times and his throat was cut, nearly decapitating him. His body was also left in the house before it was set on fire. A folding-style knife was found nearby. Officials had to use dental records to identify Kocis because his body was burned beyond recognition. On May 15, 2007, two Virginia Beach escorts, Harlow Cuadra and Joseph Kerekes, were arrested and charged with Kocis' murder. On December 8, 2008, Kerekes pleaded guilty to second-degree murder, theft, tampering with or fabricating evidence, and criminal conspiracy, and was sentenced to life in prison without parole. Jury selection for Cuadra's trial began on February 17, 2009 and the trial began one week later. On February 27th, Brent Corrigan testified for the prosecution about his dealings with Kerekes and Cuadra. Throughout the trial, Cuadra claimed that Kerekes controlled his life, equating their relationship with Stockholm syndrome. He also claimed that Kerekes was the one who murdered Kocis and that he wanted to go to police, but Kerekes kept him from doing so. On March 12, 2009, Cuadra was found guilty of all the charges against him, including first-degree murder, conspiracy to commit murder, arson, robbery, and tampering with or fabricating evidence. On March 16th, he was sentenced to life in prison without parole.

Bryan just bought him a car. I will never forget how upset Bryan was. Unfortunately Bryan is not here to tell his side of the story.

Kocis pled guilty to one count of Sexual Abuse of a Child. He was initially charged with child pornography, and transportation of a minor for sexual purposes. Since the boy had lied about his age Kocis was given a probation sentence. In 2006 a judge signed paperwork changing Kocis' charge from sex assault to corruption of minors. Kocis' former attorney, Al Flora, said the change was made because the original charge of sexual assault of a child was a mistake and that, "We didn't realize there was an error until 2006." Flora said his former client was a legitimate businessman and not at all a pedophile. Harlow Goes To Prison For Life

The jury deliberated for about five and a half hours before telling count Judge Peter Paul Olszewski Jr. they could not reach a unanimous verdict despite being given more time by the judge. The jury returned to the courtroom around 2:30 to tell Olszewski they agreed one of the factors wasn't valid, but had reach an impasse on the other. Olszewski instructed jurors to try and reach a unanimous decision. The jury foreman didn't specify which of the two aggravating factors they were undecided. underwearCuadra was found guilty of killing Kocis last week. Cuadra’s former lover and business partner, 35-year-old Joseph Kerekes, already is serving life after pleading guilty last December to second degree murder after making a deal with prosecutors. Cuadra and Kerekes saw Kocis as a business competitor; the pair wanted Brent Corrigan who at the time was under contract with Kocis. Kocis’ body was discovered in his home by firefighters responding to a blaze in the rural house in January 2007. An autopsy found that Kocis died of massive blood loss after his head was nearly sliced off. He suffered between 28 and 29 post mortem stab wounds before his home was torched.

GUILTY IN THE 1st DEGREE !!!

hc3A jury has found Harlow Cuadra guilty of first-degree homicide today in the murder of Bryan Kocis.

  A jury in Pennsylvania has found Harlow Cuadra guilty of first degree murder and all 11 other counts in Luzerne County. Cuadra, 27, was on trial for killing Bryan Kocis, 44, at Kocis' Dallas Township home in January 2007. The jury of eight men and four women began deliberating at 10:30 this morning and took less than four hours to reach the verdict.
Because it's a capital murder case, the jury will now have to decide whether Cuadra should be sentenced to life in prison or death.
Harlow's mother, Gladis Zaldiva, cried uncontrollably yelling out, “Joseph Kerekes, Joseph Kerekes, he is the killer, not my son.” She also yelled out in Spanish as she left the courthouse. Harlow showed little emotion other than slumping in the chair. He appeared withdrawn and said nothing when escorted out of the Luzerne County Courthouse about an hour after the jury found him guilty. Kocis’ parents, Michael and Joyce Kocis, tightly embraced one another as the verdicts were read just after 2 p.m. inside the crowded courtroom. They hugged District Attorney Jacqueline Musto Carroll and lead prosecutor Assistant District Attorney Michael Melnick prior to exiting the courtroom.  Jurors will hold a penalty phase hearing today (Friday) to determine if Cuadra deserves the death penalty. Harlow Cuadra Testified

harlow1Harlow Cuadra testified yesterday in his capital homicide trial and has said that his lover and business partner Joseph Kerekes murdered Bryan Kocis. Harlow related in his testimony that on the coaching of Joe he went there to Kocis' private home to discuss being a model in a Cobra Video production. Today is the 11th day of this ongoing trial and going against the advise of his attorneys Harlow described how after he arrived at the Kocis house Joe rapped on the door while he was inside and a fight between Joe and Kocis ensued and further testified "Joseph reaches in his pocket and pulls out a knife and slashed Bryan's throat. I yelled, "Joe, what are you doing, he said to get the fuck out." In further testimony by Harlow this afternoon he testifed that he ran and hid in the back seat of a rental car Joe had driven to take him to Bryan Kocis home in Dallas Township, Pennsylvania after Joe became violent. He went on to detail how the two of them were afraid and traveled to South Beach, Florida where they lived in a motel room for several months before returning to their home in Virginia Beach. Harlow explained in his testimony how he was sexually abused as a child, broke relationships with his family because he was gay and how Joe's family took him in and showed him love. He alluded to Joe being the dominate one in the relationship and described how Joe managed all the business affairs and Harlow described under oath. "I can't even go to the store to buy toilet paper without him." Harlow testified about his life in Florida, how he enlisted in the Navy in late 1999, how he fell in love with an naval officer who was later transferred to San Diego. hc11Harlow said after his lover (naval officer) was transferred, he felt alone and met Joe at a shopping mall after talking with him in a chat room online. He described how his relationship with Joe grew into the escort and gay film production business it was prior to the couple's arrest for the murders. Harlow said, "(Joe) was always with me, everywhere I went, he was with me." At the opening of this morning's session of court Joe Kerekes, (now 35 years old) refused to testify for Harlow. Joe dressed in a white shirt with the letters "DOC" on the back, and brown pants, walked into the courtroom with Harlow staring at him. Joe didn't appear to look at Harlow who was sitting at what reporters descibe as "just 15 feet away from the witness stand." Harlow's attorney Joseph D'Andrea questioned Joe about the few times he visited him at the state prison after Joe pleaded guilty for the murder after a December 2008 court hearing when was sentenced to life in prison without parole.  Joe said on the stand,  "I've been thinking a lot about my parents, I think it will destroy them to say something that I didn't do, what I told you (D'Andrea) is untrue." Following that, Joe was whisked out of the courtroom and is being held in custody in the county jail pending further needs from the court. Throughout the prosecution's case, Harlow's attorneys have attempted to blame the murder on Joe, claiming Joe was the more dominant person in the relationship. The 99th potential juror told the judge, “He looks like a kid" - “I just can’t believe he did it.” It would seem to this writer that the image he will display during this trial will be one single major thing that will have a major effect on the jury's verdict.   This gruesome murder is just like the stuff we watch on American Justice and many other true crime documentaries.
