Changing Your Name After Marriage When You’re Gay

wedding-picturesWhile changing a name after marriage can often be a struggle for heterosexual women and men, it’s a lot harder if you’re gay. Couples who live in states that don’t allow or recognize same-sex marriage or its equivalents (civil unions, for instance) generally can’t just rely on a marriage certificate as proof of a name change and instead have to go through the in-court name change process. This means they will have to pay a $100 to $400 fee to file a petition at court, publish a notice in a local newspaper and get a court order officially changing their name and that they can use to change everything else (just one more area where being gay can cost you more). Even more, couples who live in states that do allow or recognize same-sex marriage and civil unions often in practice don’t have it that much easier. While changing a name on a driver’s license can be done without a problem in such states, changing federal documentation can be trickier. Since the federal government doesn’t recognize the right to same-sex marriage, even if you get married in a state that allows it, whether you can get the name change processed by Social Security or the passport office merely with the marriage certificate and required forms currently tends “to be hit and miss,” said Emily Doskow, an attorney in California who specializes in same-sex and transgender family issues and writes about marriage and divorce issues for the legal information publisher Nolo. “It depends on what local office you are going to, what the opinion is at the moment and whether you get a staff person who cares or doesn’t care,” she said. This is despite the fact that a spokeswoman for the Social Security office said such same-sex couples should have no problems changing their Social Security cards because the marriage certificate is a legal name change document in those states and the office follows state rules in regard to name changes. In addition, while the Passport Agency used to not recognize the marriage certificates of same-sex couples as name change documents, the State Department earlier this year changed its policy to permit the document to be used as proof for a same-sex last name change if it’s a legal way to change one’s last name under a state’s law. Problems now are because of “misunderstanding and misinformation at the passport and Social Security offices,” said Karen Loewy, senior staff attorney at Gay & Lesbian Advocates & Defenders, a legal rights organization focusing on New England. “The marriage license should be enough for any name change” in a state that allows or recognizes same-sex marriage or its equivalents, she said. She said she expected the hurdles to eventually go away. But for now, she recommends that couples who face problems trying to change their Social Security cards or passports keep trying, go in person to talk with someone else in the office and bring or send in additional supporting changed identification like driver’s licenses and this document from the Glad Web site about the changed law. “There is no reason folks should have to go to court,” Ms. Loewy said. Google Offers Warning Page Advice

Responsible purveyors of age-restricted materials have been given some new advice by Google that should help in their battle for online market share. Recently, a Google Webmaster Help user asked the search giant about the Googlebot's ability to "see" past a website's age verification or "warning" page in order to be able to index the website; which in this case involves the marketing of alcohol-based products. "As the site legally requires users to be over the legal drinking age to use the site," the webmaster said, "the first page of the client's website is a gateway page asking the user to confirm their country of residence and date of birth." One example of online age-verification on an alcoholic beverage site can be found at the Absolut Vodka website. One major concern among many adult webmasters offering age-restricted materials is that Googlebot and other search engine spiders may not be able to navigate beyond this gateway page; hampering organic search marketing efforts and overall profitability — a situation which is especially troublesome for users of robust age verification systems; such as the BirthDate Verifier developed by adult entertainment industry attorney Larry Walters — which can redirect visitors landing on deep-linked web pages to the site's home page for age verification. According to Google Webmaster Trends Analyst Susan Moskwa, the topic comes up periodically for alcohol, adult entertainment and other sites that need to serve an age verification notice on every page. "What we recommend in this case is to serve it via JavaScript," Moskwa revealed. "That way users can see the age verification any time they try to access your content, but search engines that don't run JavaScript won't see the warning and will instead be able to see your content." The advice provides adult webmasters with practical insight as to how age-verification and organic search engine marketing can easily co-exist.

SAN FRANCISCO - The words "bride" and "groom" will reappear on all marriage license applications issued in California starting next month, state health officials said. In a notice posted on its Web site, the California Department of Public Health says it is making the change because many couples still wanted the option of identifying themselves in traditional terms. When same-sex marriage became legal in the state on June 16, the health department issued new gender-neutral marriage forms with the words "Party A" and "Party B" where "bride" and "groom" used to be. The latest paperwork, which county clerks will be required to use starting Nov. 17, will have blank spaces for applicants' names and personal information next to the words "First Person Data" and "Second Person Data" and optional boxes for checking "bride" or "groom." Because "bride" and "groom" appear in both sections, couples could check the same title twice to reflect a union between two men or two women. The health department also told county clerks that the designation of Groom or Bride is not required. But in the time since, state officials have looked for alternatives to satisfy couples who did not like the ring of "Party A" and "Party B," spokeswoman Suanne Buggy said Monday. The department thought it had to remove "bride" and "groom" from marriage certificates to comply with the California Supreme Court decision that legalized same-sex marriage, she said. Who's Smiling Now? Enzyte Scammer Gets 25 Years In Prison

Steve Warshak, founder of the company responsible for "Enzyte," has been sentenced to 25 years in prison and ordered to pay a fine of $93,000, says the AP. U.S. District Judge S. Arthur Spiegel also ordered the company, along with other defendants, to forfeit more than $500 million that it bilked from consumers.

According to federal prosecutors the scam involved preying on customer's reluctance to admit that they had ordered the "male enhancement" pills. Customers ordered the pills, but were unable to cancel or get a refund. A former VP of the company testified that Warshak required customers to provide notarized documents from a doctor proving that they had small genitals in order to get a refund.
If customers complained, he said, employees were instructed to "make it as difficult as possible" for them to get their money back. In some cases, Teegarden said, Warshak required customers to produce a notarized statement from a doctor certifying Enzyte did not work. "He said it was extremely unlikely someone would get anything notarized saying they had a small penis," Teegarden said.
The judge had strong words for Warshak:
"This is a case about greed," Spiegel said as he reviewed the case. "Steven Warshak preyed on perceived sexual inadequacies of customers."
Warshak's 75-year-old mother was also sentenced to jail time, but it's unlikely that she will serve it because she's 75 and has cancer. Meanwhile, Warshak has 30 days to report to prison. Ohio company owner gets 25 years in fraud case [Associated Press]
