Men Could Be Registered As "Sex Offenders" After Police Sex Sting

Palm Springs, California police, preparing to conduct a gay sex sting last summer, pushed the district attorney's office to agree in advance to pursue more severe penalties than in prior stings, court documents show. All 24 men arrested in the 2009 Warm Sands neighborhood sting, which police say stemmed from complaints of sex in public, now face charges that would require them to register for life as sex offenders. A District Attoney in the matter has told a prosecution team about the agreement with the police and instructed that anyone arrested in the sting could only plead under California Penal Code section 314, which calls for a lifetime sex offender registry.   Read the full story at The Desert Sun, it seems that the local community remains divided judging from the foregoing reader's comments:
You can be charged as a "sez offender" if you are caught peeing in public. Up to the DA to decide. If you have an over zealous DA who wants to give the appearence of "tough on crime". Many of them are just trying to get on the next rung up on the carrer ladder.

Britney Spears went gay this past weekend for the annual White Party in Palm Springs, California, so she could cheer on pop pal AGNES. The Toxic hitmaker made an unscheduled appearance at the closing event of the weekend's festivities, which featured a performance from her manager Larry Rudolph's new act, Agnes, according to Eonline.com. Reports suggest promoters built a special platform for the pop superstar - so she wouldn't be mobbed by gay fans. And Spears appears to have enjoyed the event - in a 'tweet' to fans, she writes, "Sooooo fun!!!"

White Party's 21st Anniversary Kicks Off In Palm Springs

Palm Springs kicked off Thursday the White Party 2010 - among the world's largest gay celebrations - with a proclamation marking the event's 21st anniversary. Mayor Steve Pougnet and Councilwoman Ginny Foat will present the event's producer, Jeffrey Sanker, with the proclamation at the Renaissance Palm Springs Hotel, 888 E. Tahquitz Canyon Way, said city spokeswoman Amy Blaisdell. The hotel will be serve as headquarters for the party, which will feature performances from Kim Zolciak of "The Real Housewives of Atlanta" and pop-sensation Kesha, along with Agnes Carlsson, the winner of the "Swedish Idol" competition. The party has grown to become one of the largest and most recognized gay events worldwide, according to Blaisdell. The weekend will officially begin at 9 p.m. with the White Party Welcome at Dink's Ultralounge, featuring DJ Scotty Thomson.

Further Developments in the Palm Springs ‘Gay Grifter’ Murder/Scam Case

murder_scene-300x225A San Francisco attorney and his former client are among five men being prosecuted for their alleged roles in the killing of a gay Palm Springs retiree as part of a plot to steal his financial assets. And in the latest developments involving this case, a lawyer for another homosexual man now claims that pair hatched a separate plot to get his client's fortune. David Replogle, 60, and Danny Garcia, 27, along with Kaushal Niroula, 28, Miguel Bustamante, 26, and Craig McCarthy, 29, are accused in a scheme to kill Clifford Lambert at his Palm Springs home to steal his identity and raid his financial assets. Deputy District Attorney Lisa DiMaria has alleged that the men preyed on the 74-year-old Lambert, whose partner died in 2007. Garcia, who met Lambert on the Internet, provided the connection to his co-conspirators, the prosecution alleges.

The men are scheduled to appear in court Nov. 13 to determine when the case will go to trial.    
  Replogle and Garcia had worked together in the past in a case in which a multimillion-dollar settlement was reached with a wealthy, older homosexual man, court documents show. In 2003, Replogle filed two civil suits — seeking $100 million in damages — alleging that Thomas White, a 73- year-old former San Francisco stockbroker, had illegal sex with Garcia when he was 16, and molested about 20 underage boys in Mexico. White, who is jailed in Puerto Vallarta, Mexico, faces U.S. and Mexican charges alleging he traveled to Mexico to have sex with boys. A federal grand jury in San Francisco indicted White in March 2004 on two counts of sex tourism and one count of bringing pornography into the United States. A federal warrant has been issued for White's extradition to California. Replogle was involved in the negotiation of a $7 million settlement with White, which his attorneys have been trying to nullify based on allegations of a frame-up. Stuart Hanlon, White's attorney, said White has claimed from the beginning that Replogle and Garcia set him up and then blackmailed him for a settlement. Hanlon said White settled because of advice from his then-lawyers that it would be difficult to disprove the claims. “Everybody looks at Tom's case and they say he's a pedophile, he's rich, he's awful,” Hanlon said. Hanlon alleged he has evidence of a set-up from a sworn declaration Garcia gave to Mexican lawyers in 2006 after he had an apparent falling-out with Replogle. According to the declaration, Garcia said he traveled with Replogle to Puerto Vallarta to find and pay young homeless boys to sign a document saying they had been molested by White. Garcia alleged that Replogle “would give to each of the above-mentioned boys an amount ranging from 100 to 200 dollars every week or every two weeks, depending on how often David Replogle came to this city,” according to the declaration. Now that Garcia and Replogle are being prosecuted in Riverside County for Lambert's death, Hanlon said he hopes federal authorities will review the case against White.

2009 Greater Palm Springs Pride Festival and Parade Hits This Weekend

best_gay_palm_springs_rainbowThe 2009 Greater Palm Springs Pride Festival and Parade will return to downtown this weekend with noted gay community member Cleve Jones riding along as Celebrity Grand Marshal in Sunday's parade along Palm Canyon Drive. The two-day festival, slated for Saturday, Nov. 7 and Sunday, Nov. 8 will kick off both days at 10 a.m. at Palm Springs Stadium. This year's theme is "Your Rights, Our Rights, Human Rights." The festival, which will feature two food courts, more than 200 booths, a Country Western Dance Tent and a host of music entertainment - including headliner and international dance diva, Pepper Mashay - is expected to draw more than 20,000 people. The always popular Greater Palm Springs Pride Parade will follow on Sunday, Nov. 8 at 10 a.m. along Palm Canyon Drive. Mayor Steve Pougnet, his partner and their two children will ride along -- as well as Mayor Pro Tem Chris Mills and City Council members Ginny Foat, Rick Hutcheson, Lee Weigel and their families. 'Gay Grifter' Murder Case Continues To Develop

murder_sceneA judge on Monday set a September 3rd preliminary hearing date for five of six men charged in the murder of a Palm Springs retiree to steal his assets. The preliminary hearing -- which has been reset several times -- will determine if there is enough evidence to order the defendants to stand trial on first-degree murder and other charges in the Dec. 5 death of 74-year-old Clifford Lambert. Charged in the case are alleged con man Kaushal Niroula, 27, and San Francisco attorney David Replogle, 60, along with Miguel Bustamante, 26, Craig McCarthy, 29, and Daniel Garcia, 26. An arrest warrant has been issued for Russell Manning, a 67-year-old San Francisco art dealer, who is believed to be in Mexico.
 
  McCarthy, a former Marine who was arrested in San Francisco on July 17, is accused of holding Lambert while Bustamante stabbed him, and then cleaning up the blood and helping Bustamante and Niroula dispose of the body. Investigators have not said whether they have found the victim's remains.

The six are accused of hatching the murder plot and, after Lambert's death, stealing property from his residence, emptying his bank accounts and trying to sell his $1 million home for less than $300,000.     Bustamante was caught by police while emptying Lambert's home, and he implicated the other men in Lambert's murder, according to prosecutors. Manning is accused of transferring the victim's money out of one of his bank accounts several days after the retiree was reported missing. Repogle allegedly forged a signature on a power of attorney document that was used by some of his co-defendants to fraudulently sell the victim's home, and Garcia was caught with Lambert's debit card when he tried to withdraw money from one of the retiree's accounts on several occasions. 1864December's Gay Grifter murder, in which a quartet of sex-partner-swapping purported San Francisco con men allegedly killed a lonely, elderly Palm Springs man then attempted to fraudulently sell his house had, until this week, seemed to lack a key plot element: How did police think they actually bumped off the poor old guy?  We knew that Nepalese immigrant and alleged serial con man Kaushal Niroula, along with four local co-conspirators, allegedly made a 74-year-old Palm Springs man disappear and proceeded to start emptying his house and trying to sell it for half its value.  But we knew precious little about police's theory about the disappearance -- until late last month, when Palm Springs police announced the arrest of a sixth suspect named Craig Anthony McCarthy, age 29.BREAK According to a criminal complaint, Niroula flew with McCarthy and Miguel Bustamante -- a former barkeep at Jet in the Castro -- from San Francisco to Palm Springs on December 2, three days before 74-year-old Clifford Lambert was last seen alive.  Police say Niroula disarmed the burglar alarm at Lambert's house and let the other two men inside. McCarthy is accused of grabbing Lambert from behind and and holding a knife on him as Bustamante allegedly stabbed the victim.  Notwithstanding the new allegations, the police update still leaves a significant mystery hanging: They still have not revealed whether they have a body, or if they even have an inkling of how Lambert's corpse was disposed of.

    Her show started at 1:45 a.m. on Sunday, perhaps timed with what is known as “last call” when bars must stop selling alcohol in California. Lady Gaga’s show was a combination of raunchy craziness and the music she is known for– such as ‘Poker Face” and ‘Just Dance.’

    Lady Gaga performed at White Party 2008, but this year she was the headliner, a significant sign of her success in the music business. During the show she thanked her gay fans, and expressed support for same-sex marriage in California. At one point she drew wild screams from the crowd asking that people “kill Prop. 8.” Proposition 8 is the measure which was narrowly approved by California voters on the November ballot.

    White Party Serial Rapist

    white_party_week_gay_circuit_party_palm_springsFliers are being posted around Palm Springs claiming there is a serial rapist on the loose. The police says this is false and that there is nothing to worry about. But one man speaks out to News Channel 3 saying he was the target of a rapist who used date rape drugs. The White Party brings in around 25,000 gay men and their much-needed tourism dollars to Palm Springs. One flier is making the rounds in some neighborhoods. It warns of a rapist targeting gay men by slipping date rape drugs in their drinks. Kevin Bond says he is one of those rape victims.
    "I was asleep at one of my friend's house and I woke up in the morning and I was bleeding and my head left that it had been bashed in. I really didn't know what had happened to me.
    I was wearing a pair of jeans. I put them on that morning and just felt blood. Knew it was blood. There was blood all over the crotch area of the jeans. An inordinate amount of blood. Something I had never seen before. It scared me a lot," said Bond.
    Bond went to the Desert AIDS Project. He said he tested positive for Hepatitis C after the rape. But Bond claims Palm Springs Police never took him seriously. He accused them of not caring about crimes between gays. Palm Springs Police denies any rape investigation is going on. They say the fliers Bond and others are posting are false. Sergeant Mitch Spike even goes so far as saying he believes Kevin Bond has "mental issues." But the American Civil Liberties Union wrote a letter on behalf of Kevin Bond. It says "the police department response is inconsistent with the city's welcoming attitudes" towards gays and lesbians.
    Bond added, "I figured if I wasn't going to get the support from the Police Department, going out and looking for these people actively, I would do it myself. I learned a lot of things online about how to be an advocate for your own rape case. The only way you can do that is to put the word out on the street this is happening."
    Stores and bars along Arenas Road have not heard much about these rumors. But knowing that word is spreading around the community, they'll be even more careful.
    "I'm frustrated. I'm angry. I think if people saw what I went though and saw the crime scene and knew what I went through knowing I now have a disease that could kill me because of this, it's very frustrating to know what I've been put through. And it's frustrating that there are people out there who could be helped if we got the word out," said Bond.
