Gay Man Pleads Guilty In San Diego To Murder And Burying Victim Inside Concrete Egg

To avoid a possible death sentence, a gay man who strangled another man and entombed his body inside a concrete egg decided to plead guilty on March 18 to first-degree murder. It’s no plea bargain for parolee Thomas Jeffrey Brooks, 41, who faces a state prison term of 75 years to life. Brooks admitted killing Edward Andrews, 80, in 2008, and also pleaded guilty to 13 burglary counts involving theft of Andrews’ credit cards, which Brooks and an accomplice used at stores and for cash advances.
Sentencing was set for June 22 by San Diego Superior Court Judge David Gill. Brooks remains in the San Diego central jail on $3 million bail.
Brooks’ attorney, Gary Gibson, told reporters after the plea that Brooks was motivated to plead guilty because he might face the death penalty if convicted at trial. District Attorney Bonnie Dumanis had not yet made the decision to seek the death penalty, but Brooks had been charged with the special circumstance of murder for financial gain.
Deputy District Attorney Dino Paraskevopoulos said Brooks will have to serve a minimum 75-year term before he could be eligible for parole. He said Brooks put a personal ad in a gay magazine based in Palm Springs while Brooks was in a Florida prison.
Brooks described himself as French and 25 years old, and Andrews began writing to Brooks as a pen pal, said the prosecutor. When Brooks was paroled in 2007, he went to live with the elderly gay man in his mobile home in Hemet. Andrews disappeared around June 1, 2008.
“Elders, when they get lonely, they may let their guard down. This defendant was a mastermind criminal,” said Paraskevopoulos, who added that Brooks had a long criminal record that included arson, child abuse, possession of child pornography and many thefts.
Brooks wrote a neighbor to Andrews while claiming to be Andrews and said they were on a European vacation. It drew suspicion from the neighbor because the neighbor’s first name was misspelled throughout the letter. Brooks put Andrews’ body in a cement casing that he kept adding newspapers and other materials to it.
The bizarre structure was left as part of a rock garden in the back yard of a house in the 3400 block of Alabama Street in North Park. Andrews was found with a belt around his neck and duct tape was placed across his mouth. His legs were lifted up to his chest and the body was surrounded by chicken coop wire, and then covered with a purple blanket, plastic tarp, and concrete.
Brooks was a friend to Ben Mason, who rented his own condo to Brooks, whom he knew under an alias. Mason lived at the Alabama Street house with two other roommates. One roommate broke open a part of the cement orb and Mason testified he saw a “shriveled foot” accompanied by a foul odor on Sept. 5, 2008.
Mason testified the concrete egg was ugly, weighed about 300 pounds, and it looked like a paper mache rock. Mason said Brooks told him he wanted the orb to be “the centerpiece of the formation” of the rock garden, and that Brooks said he felt “peaceful and serene in the back yard.”
The roommates called San Diego Police upon seeing the foot, and they stayed up all night answering questions separately from officers as to why a body in such a structure was in their back yard. They were not charged with any wrongdoing.
On Feb. 11, Arlo Elizarraraz, 20, of Chula Vista, was sentenced to nine years in prison after pleading guilty to being an accessory to murder after the fact and 55 counts of fraud involving the victim’s bank account and credit cards.
Elizarraraz purchased the cement, chicken wire and a shovel at Home Depot, but said he did not know it was to be used to entomb a body. Brooks told police that Elizarraraz was not involved in the murder. In sentencing Elizarraraz, Judge David Danielsen said his actions involved “disrespect (of) the remains” and “to participate in any way with what happened to the victim … is truly as black and criminal as much as doing the deed itself.”

Two Dead Gay Men Found In San Diego, Murder-Suicide Investigation Underway

Two men are dead in what appears to be a murder-suicide in a San Diego, California apartment on Friday. San Diego police, conducting a welfare check at La Hacienda Apartments in the 3900 block of Wilson Avenue, found the two bodies around 4 p.m. "The door was closed," described Lt. David Nisleit with the San Diego Police Department.  "We could see inside that there were two dead males on the ground." A co-worker of one of the men had requested the welfare check after the person failed to show up at work. Police say they also found a gun inside the apartment.  It's not known how long the bodies lay there, but neighbor Steven Stuhler heard gunshots just the day before. "I heard about 6 or 7 gunshots," Stuhler told San Diego 6.  "And the cops saw me walking down the street and they started asking me some questions." Police have not identified the men but the gay & lesbian news website GLTNN says they are Eric Schulthise (photo-left) and Bob Agnew (photo-below).  Schulthise worked at SeaWorld and was a go-go dancer at the North Park bar Bacchus.  Bob Agnew was a former Naval Academy instructor.  The site claims the two men dated off and on. Neighbors report having seen the two men recently arguing in front of the building. Beware Of 'Street Trade' In San Diego! Police Seek Thief Targeting Gay Men

San Diego, California Police are asking for the public’s help to identify a thief who appears to be targeting gay men at a Hillcrest bar according to the Union Tribune. The suspect, who has identified himself as “Paul” or “John,” has picked up at least two men on separate occasions Dec. 2 and 18 at Urban Mo’s on University Avenue near Third Avenue, San Diego police said. The victims, who were in their 30s, ended up inviting the suspect back to their homes in North Park and Bankers Hill. When they woke up, they discovered that items such as laptops, cash, credit cards and Chargers gear had been stolen. Investigators believe the suspect may have slipped drugs into his victims’ drinks to knock them out. The thief is described as black, in his 20s, between 6 feet 1 inch to 6 feet 3 inches tall, about 170 pounds, bald, with a thin build and a gold earring in his left ear. Anyone with information can call police at (619) 744-9500 or leave an anonymous tip with Crime Stoppers by sending a message through the Web site www.sdcrimestoppers.com or by calling (888) 580-8477. Tipsters may be eligible for a reward of up to $1,000 for information that leads to an arrest.

Leadership Of San Diego Gay Pride In Uproar!

Dissension is roiling the leadership of San Diego Pride, which hosts an annual gay-celebration parade and festival that have become one of the county’s largest civic events. The board of directors, which already had dropped to three members after two recent resignations, fired Executive Director Ron deHarte on Tuesday. Board members cited communication problems and disagreements between them and deHarte about the direction of San Diego Pride. But deHarte said he was terminated for complaining about a decision by the all-volunteer board to waive its bylaws and award its chairman a $5,000 stipend in October. Board members initially defended their payment decision this week. But after facing calls for their own resignations, they promised late Tuesday in an open letter to the gay community that the money will be repaid. They also apologized for their “indiscretion.” “There was no malfeasance and the whole intention was to give me a gift for service above and beyond the call of duty,” said Chairman Philip Princetta. “In hindsight, the one thing that wasn’t considered was the public perception.” He said there’s no timetable for returning the money. DeHarte, 45, had been at the helm for four years. He said he will seek reinstatement for himself and two other Pride staff members who resigned after he was fired. Headquartered in North Park, Pride is a nonprofit organization with an expected operating budget of about $1.8 million for this year. The group is best known for the parade on University Avenue in Hillcrest, which draws more than 150,000 people, and an accompanying two-day festival. This year’s Pride celebration is scheduled for July 17-18. DeHarte was roughly halfway through the planning cycle for the event when he was let go. Board secretary Carl Worrell praised deHarte for “building a strong, well-trained staff” but said directors had grown increasingly frustrated in their dealings with him. “We felt he was not being totally transparent in his communication to us,” Worrell said. Worrell also denied that deHarte’s criticism of the Princetta stipend played any role in the firing. Worrell said the money was designed to thank the chairman for his service since joining the board in 2002. At the time, the board had to waive a bylaw that bans directors from being compensated. Worrell called it “a one-time occurrence.” DeHarte said he was alarmed when he first heard about the stipend and asked the board to explain. “It was done in secret, without any established procedures, and goes against the intent of the bylaws and our long-standing traditions,” he said. Continued protest — including writing a letter this week asking the board members to resign and return the money — led to his firing, deHarte said. “I’ve been speaking out against something I think is wrong and will cause a loss of trust in the organization in the eyes of the public,” he said. Because of the prominence and success of Pride events, the management rift has riled the gay community. Several leaders, including activist Nicole Murray-Ramirez, have called on the current board members to step down. Princetta dismissed much of the controversy as “pure spin” and an attempt by deHarte and others to take over the organization. A public meeting to discuss the issue will be held 6 p.m. Sunday at The Center in Hillcrest, 3909 Centre St.

A jury in San Diego deadlocked 8-4 on Tuesday in the murder trial of 62-year-old Gerald Metcalf, who’s accused of fatally stabbing a gay man at least 61 times after they met in a popular cruising area in 1971. Metcalf was arrested in 2008 at his home in Chandler, Texas, after a cold case unit linked him to 27-year-old Gerald Jackson’s murder using DNA evidence and fingerprints from the scene. Killer Faces Jury 38 Years After Murder Of Gay Man In San Diego

Gearld_MetcalfAfter 38 years, a 62-year-old Texas man faced a jury for the first time this week for a 1971 murder of a gay man who picked him up in a seedy cruising area downtown San Diego and allegedly stabbed him 61 times in the victim’s Pacific Beach apartment.   Fingerprints and DNA evidence from discarded cigarette butts were saved in the apartment of Gerald Jackson, 27, and they led San Diego Police to arrest Gerald Dean Metcalf (pictured left) in August, 2008, in his home in Chandler, Texas, where he lived with his wife. Metcalf was 24 years old at the time of the slaying.   His attorney, David Lamb, told a San Diego Superior Court jury on Tuesday, Dec. 8, that “we’re not disputing the act” that killed Jackson and conceded that Metcalf had done it. But the issue is his state mind, Lamb said, who told jurors that Metcalf had been diagnosed with schizophrenia years ago. “This case is about the disease of the mind,” said Lamb, who said that Metcalf had rebuffed sexual advances from another homosexual in the past and that made him panic. “It was a perfect storm of terrible circumstances,” Lamb said, adding that Metcalf had been drinking alcohol all day.   Lamb is not pursuing an insanity defense, but is expected to argue that Metcalf lacked the intent to commit murder, and may suggest a lesser verdict of manslaughter at the end of the trial, as he did not specify a verdict he was seeking in his opening statement.   Deputy District Attorney Jill Schall said Jackson was stabbed at least 61 times in his bed on Dec. 29, 1971. Schall tried to paint a portrait of the time, saying Horton Plaza in 1971 “was not as nice as it is now.” She said Jackson worked at the Barbary Coast bar and met Metcalf around 2 a.m. and invited him home. Jackson was a Vietnam veteran, but did not tell his parents or siblings about being gay, said Schall, who said that was typical of the time for many gay people. “This was before gay pride parades,” Schall said.   When Jackson failed to show up for work at the post office, two friends came to his apartment on Jan. 2, 1972. One of them removed a window screen and was able to unlock the door. They were shocked to discover the grisly scene, and called police. Jackson was found without clothing on his bed.   Schall told jurors and Judge David Gill that Metcalf stole Jackson’s Ford Torino, a stereo receiver set that his father gave him for Christmas, and used Jackson’s identification when he pawned the stereo. Metcalf left a bloody palm print on the stereo, which was found by police. There was a bloody hand print to the light switch which was found on by his friends, who also told police they could hear Jackson’s alarm clock going off, Schall said.   A new witness has surfaced, the prosecutor told jurors, and it was a man named Eddie who was a friend of Metcalf and who had driven him from Texas to San Diego in 1971. They worked for Rohr Industries during a strike for six weeks, but were out of work in mid-Dec., 1971, she said, and they talked of what they could do. “Maybe I’ll roll a queer,” Metcalf was quoted as telling his friend, Schall said.   In 2008, a police intern compared the fingerprints of the killer with fingerprints from Texas on a data base and scored a hit.   Metcalf remains in the Vista Detention Facility on $1 million bail. Gay Man Says He Was Victim Of Brutal Hate Crime In San Diego's Gay District

hillcrest_gay_bashA man claims he is a victim of a hate crime after being attacked outside a popular restaurant in the Hillcrest area of San Diego. Bronti Kelly told 10News he was walking along the sidewalk in front of Baja Betty's when out of nowhere a man hit him in the back of the head. Kelly was released from the hospital Thursday evening after he said he was beaten into unconsciousness just after 10 p.m. Wednesday. Kelly, who is gay, said he believes it was nothing more than a random hate crime carried out by a man in his 30s. Kelly also said he thinks his attacker was a skinhead. "He ran up behind me, knocked me to the ground, then picked me up, punched me about 3 or 4 times, and then I was out," said Kelly. Kelly was diagnosed with a concussion and had to have 18 stitches sewn into his forehead. Four of his upper front teeth were knocked out. Police told 10News that at no time has Kelly reported to them that a hate crime occurred. Police said Kelly acknowledged being assaulted by a man while walking down the sidewalk in Hillcrest. "I'm a gay male. He targeted me as a gay male. That's what makes it a hate crime," said Kelly. Kelly told 10News he just wants justice served and wants the man who beat him bloody caught. "He was a Caucasian male, short hair, slight mustache, tattoo on the left side on his shoulder, white T-shirt, blue jeans, white sneakers," said Kelly. Navy Forces Resignation of Chief Who Hazed Gay Sailor

joseph-rochaThe Navy has removed Senior Chief Michael Toussaint from active duty and censored him for his role in hazing several sailors, including one on the basis of his homosexuality. The move comes after Congressman Joe Sestak (D-PA) raised questions on behalf of the gay veteran, Joseph Rocha. Rocha, now a political science student at USD, said he suffered verbal and physical abuse as he tried to abide by the military's "don't ask, don't tell" policy regarding sexual orientation in the military. "My dream has always been to graduate from the Naval Academy" said Rocha. But, he also knew he was gay--and that he had to keep that fact under wraps. He headed to Bahrain to work training K-9s. But his superior, Chief Master-at-Arms Michael Toussaint, had his suspicions about Rocha. "Do you think there is anything funny about Rocha?" he would ask.

Then, the hazing started. "For whatever reason, without any proof, he decided my hazing would be focused on my sexuality." It included, "being ordered to simulate gay sex on video, finding myself on my knees when I was just trying to serve in the Middle East, coached as to how to have gay sex, all on camera with military dogs around." Rocha didn't know what to do. He was worried that if he reported the abuse, he would have to admit he was gay. "I didn't want to lose my career over it." The abuse continued. Gay porn was saved on his computer and comments were constantly made. "He was indoctrinating new handlers that they would soon meet a gay, ultra liberal service member." But, he wasn't alone in hazing abuse by Toussaint. A Navy report has over 90 complaints. Among them: sailors were "hog-tied...force fed liver dog treats and told to make dog and duck sounds." Navy spokeswoman and Commander Elissa Smith said that Michael Toussaint's enlistment extension has been canceled, which will force him to leave active duty and retire in January 2010. His retirement pay will be reviewed at a hearing. Smith said, "...the incidents were not in keeping with Navy values and standards and violated the Navy's longstanding prohibition against hazing...Our sailors are to be treated with dignity and respect in a healthy and positive working environment." Rocha said he was "surprised" and "proud" of the decision. He is disappointed that Toussaint will not face court marshall, though. Still, he views it as a big development for gay rights. "For the first time this has been a national acknowledgment from our military leadership, active duty military leadership, that our service is equal." He continued, "this kind of abuse, and this kind of bigotry and homphobia and hatred does not line up with the core values, neither of our military nor of this country and I think that's the finest thing to take from today."

Westboro Baptist Descends on San Diego Gay Community:

westboro_san_diegoMembers of a Kansas-based church known for spreading anti-gay and anti-Semitic messages are in San Diego. The Westboro Baptist Church members plan to visit churches, synagogues and high schools around the county throughout the weekend. On Friday, a group was in Sorrento Valley, carrying signs that read "America Is Doomed" and "God Is your Enemy." The group on Oberlin Drive was very small. The three adults and three children set up about a half-block away from San Diego Jewish Publications, the group's intended target, according to its Web site. There were actually more members of the news media present than protesters. "They're nuts," said Dale Goodman of Mira Mesa, a veteran who waved an American flag as part of a counterprotest, with one participant holding a sign that read, "Go Back to Kansas." Several other onlookers expressed shock, and passing drivers honked and shouted obscenities at the group. Elsewhere around the county, three of the adult protesters from Kansas and two of their children showed up in the afternoon across the street from San Diego High School. Hundreds of counterprotesters, many of them from San Diego's gay community, were on the school's side of the street. The Kansas group, which was ringed by five San Diego police officers, was hard-pressed to get out their message because they were surrounded by news media. The counterprotesters, due to their sheer numbers, were much louder, playing music and chanting slogans.
